For what purpose do we process your personal data?
ANECA processes your data to evaluate your application for state accreditation for admission to university teaching positions, as referred to in Royal Decree 678/2023 of July 18, which regulates state accreditation for access to university teaching positions and the system for competitive examinations for such positions, replacing the procedure regulated by Royal Decree 1312/2007, of October 5, establishing national accreditation for access to university teaching positions.
No automated processing of personal data is performed.
ANECA may conduct opinion surveys and studies to improve the quality of its Academia Program, the university system, and ANECA itself, being authorized to do so as this processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller. To this end, ANECA may contact you using the contact information provided in your accreditation application to conduct such studies and/or surveys for these purposes, participation in which will in all cases be voluntary.
How long will we keep your data?
Personal data will be retained for the time necessary to fulfil the purpose for which they were collected and to identify any liabilities that may arise from that purpose and the processing of the data. The provisions of the legislation on files and documentation shall apply.
What is the legal basis for the processing of your data?
The legal basis for the processing of your data is the fulfilment of a legal obligation that ANECA has as well as the fulfilment of a mission carried out in the public interest or in the exercise of public powers conferred upon it (art 6.1. Letters c and e of the General Data Protection Regulation), in accordance with Organic Law 2/2023, of 22 March, on the University System the Royal Decree 678/2023, of 18 July, which regulates the state accreditation for access to university teaching bodies and the system of competitions for access to positions in these bodies and Royal Decree 1112/2015, of 11 December, which approves the Statute of the Autonomous Body ANECA.
To which recipients will your data be disclosed?
In accordance with the applicable regulations, its data may be communicated to the Council of Universities within the framework of the accreditation procedure.
Likewise, they may be sent to Judges and Courts, the General Intervention of the State Administration, and the Court of Auditors, when so required by ANECA.
International data transfers are not foreseen.
ANECA will publish on its website the state accreditations granted in the event of a favourable resolution, in accordance with the regulations of the procedure.
What are your rights when you provide us with your data?
Any person has the right to obtain confirmation as to whether or not ANECA is processing personal data concerning them.
Data subjects have the right to access their personal data, as well as to request the rectification of inaccurate data or, where appropriate, to request their deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected.
Under certain circumstances, data subjects may request the limitation of the processing of their data, in which case the data will only be kept for the filing or defence of claims.
Under certain circumstances and for reasons relating to their particular situation, data subjects may object to the processing of their data. ANECA will cease to process them, except for compelling legitimate reasons, or the filing or defence of potential claims.
In the event that you have authorised ANECA to use your personal data provided in your application for national accreditation to carry out opinion surveys and studies to improve the procedures applied in your Academic Programme, you may withdraw your consent without affecting the processing of your data to carry out the assessment of your application for national accreditation, and without affecting the lawfulness of the processing based on the consent given prior to its withdrawal.
